Terms and Conditions (GTC)

1. General points & validity of the General Terms and Conditions
1.1 The general terms and conditions (hereinafter referred to as GTC) regulate the comprehensive terms and conditions and services between the Fenek.Shop and its customers.
1.2. Deviations from these terms and conditions are only effective if we confirm them in writing.

2nd offer
2.1. The offers on the Fenek.Shop web shop are subject to change and are not to be understood as binding offers. An order only comes about through the order confirmation via e-mail or through the delivery of the ordered goods. The availability of the items by our suppliers or manufacturers remains reserved.
2.2. The information in our sales documents (drawings, illustrations, dimensions, weights and other services) are only to be understood as guide values and do not represent any guarantee of properties unless they are expressly designated as binding in writing.

3. Prices
3.1. All Fenek.Shop prices are shown in CHF and are subject to change.
3.2. Technical changes, errors and misprints are reserved.
3.3. Fenek.Shop can make price changes at any time and without prior notice.

4. Shipping Costs
4.1. Unless explicitly stated otherwise in the order, we deliver all products ordered via the Fenek.Shop webshop without a special note, with the stated shipping costs within Europe.
4.2 . The items can be picked up at a location defined by Fenek.Shop in advance agreement with Fenek.Shop. Advance notice is mandatory. If the buyer picks it up, the listed shipping costs for the item are therefore no longer applicable. The buyer can also have the goods picked up by a third party, provided the buyer has informed the Fenek.Shop accordingly. The buyer assumes the risk. The products will not be handed over without prior notification and identification of the buyer. The delivery will only take place if payment is made at the same time or in advance.
4.3. A delivery to other countries will be checked on request. However, Fenek.Shop does not guarantee the ability to deliver outside of Switzerland and the Principality of Liechtenstein.

5. Payment
5.1. The delivery takes place only against payment in advance. Payment on account is not possible.
5.2. Fenek.Shop accepts prepayment, credit cards or PayPal as payment methods. When paying by credit card or Paypal, the commission rate published on the website is charged to the buyer.
5.3. Without special agreements, a payment period of 10 days after placing the order applies.

6. Late Payment
6.1. If the customer fails to settle his debts after the grace period set, Fenek.Shop can claim damages and proceed in accordance with the provisions of the Swiss Code of Obligations (OR). In particular, Fenek.Shop has the right to assign outstanding debts to external debt collection companies.

7. Delivery
7.1. The delivery takes place depending on the selection, by shipping or by collection, of the buyer. Once the order has been placed, no changes to the delivery can be made.
7.2. The specified delivery times are only to be understood as guide values. These are not binding. If a delivery deadline cannot be met, the customer can withdraw from the order placed after a grace period of at least 14 days, which he must notify in writing. The customer cannot assert any further claims.
7.3. Confirmed orders can be canceled by Fenek.Shop without incurring any costs due to external circumstances that cannot be influenced.
7.4. The transport risk is transferred to the buyer as soon as the shipment has been handed over to the transport company. However, the shipment is insured to a limited extent by Fenek.Shop. Damage to the delivered goods must be reported to Fenek.Shop as soon as possible, but no later than 4 calendar days after delivery. In the event of complaints, all parts of the original packaging must be kept. These may only be disposed of with the written consent of the transport company or Fenek.Shop.
7.5 . Delivery is always to the curb. No floor deliveries are offered.

8. Warranty
8.1. Unless otherwise expressly agreed in writing, the warranty is 24 months in accordance with the following provisions.
8.2. The warranty begins with the delivery date. If the defect is due to improper use, storage or handling, the warranty is void. Insignificant deviations from the guaranteed properties of the goods do not trigger any warranty rights.
8.3 . Warranty claims against Fenek.Shop are only available to the direct buyer and cannot be assigned to third parties.
8.4. The buyer is exclusively entitled to rectification or exchange (replacement delivery). Rescission and reduction are excluded. The decision to repair or exchange an item lies with Fenek.Shop.
8.5. Wear parts, batteries and rechargeable batteries are excluded from the guarantee.

9. Exchanges and Returns
9.1. In principle, there is no general right of return. However, we offer you a 14-day right of exchange. Items can be returned within 14 days of receipt of delivery and money will be refunded to you in the form of a merchandise voucher. However, the return must be agreed with us in advance and the return requires the written consent of Fenek.Shop.
9.2. The goods must be complete, undamaged, unused and in their original packaging. Used, assembled goods or goods that are not in their original packaging are excluded from the right of exchange.

10. Limitation of Liability
10.1. In accordance with these General Terms and Conditions and the remaining contractual provisions, Fenek.Shop undertakes to provide the customer with due care when providing the services and the camping products offered.
10.2. Claims for damages due to impossibility of performance, breach of contract, culpa in contrahendo and tort are excluded both against us and against our vicarious agents, unless intentional or grossly negligent action is involved.
10.3. Liability for indirect damage and consequential damage resulting from use, faulty performance or loss of performance is excluded.

11. Privacy
11.1. Fenek.Shop is entitled to process the data received about the buyer in relation to the business relationship or in connection with this, regardless of whether it originates from the buyer himself or from third parties, within the meaning of the Federal Data Protection Act.
11.2. Personal customer data is treated confidentially and not passed on to third parties.

12. Changes to Terms and Conditions
12.1. We reserve the right to change the terms and conditions at any time. The terms and conditions as published in the web shop apply. For purchase orders that were placed before the changed GTC came into effect, the previous GTC also apply after the changed GTC came into force.

13. Jurisdiction
13.1. The place of jurisdiction for all disputes with Fenek.Shop is - subject to mandatory deviations - Berneck. The legal relationship is subject to Swiss law.
